These Terms of Use ("Terms") govern your use of the Skein mobile application ("the app"), developed and published by Thomas Masters ("we", "us"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Skein for your own non-commercial entertainment on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
Your use of the app is also subject to Apple's Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple Standard EULA conflict, the more protective terms for the user apply to that specific issue.
You agree not to: reverse engineer, decompile, or attempt to extract the source code of the app except to the extent permitted by law; use the app for any unlawful purpose; or interfere with the normal operation of the app.
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or related to your use of the app. Our total liability for any claim relating to the app shall not exceed the amount you paid for the app and its in-app purchases in the twelve months preceding the claim.
These Terms remain in effect while you use the app. You may stop using the app at any time by deleting it. We may suspend or discontinue the app, in whole or in part, at any time.
We may update these Terms from time to time. The "Last updated" date above will reflect any changes. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.
